Hospitality Radar

Terms of Service

1. Provider and scope

1.1 The provider is ligea GmbH, Hardtstraße 37a, 76185 Karlsruhe, Germany ("we"). 1.2 These terms govern the use of Hospitality Radar ("Service"). 1.3 The Service is offered exclusively to businesses. We do not conclude contracts with consumers. 1.4 Terms of the customer do not apply, even if we do not object to them.

2. The Service

2.1 Hospitality Radar is a data service on hotel projects in vision, planning, construction and renovation, and on the companies involved in them. The overview is free. Detailed files on projects, companies and cities ("files") are opened with credits. 2.2 Files are compiled from public sources with care. Projects change, are delayed or cancelled. We do not warrant that a file is complete, current or correct, nor that a project will be realised. 2.3 Files contain company information. We do not sell personal contact data. 2.4 We aim for high availability but do not guarantee uninterrupted access. Maintenance is carried out where possible outside European business hours.

3. Accounts and seats

3.1 An account belongs to one customer organisation. Sign-in uses a one-time code sent to the work email of each seat holder. 3.2 The number of seats follows the plan. A seat is personal and may not be shared. Additional seats can be booked. 3.3 The customer keeps sign-in access confidential and tells us without delay about misuse.

4. Plans, credits and files

4.1 Plans and prices are shown on the pricing page at the time of the order. Prices are net plus statutory VAT. For customers in another EU member state with a valid VAT ID, the reverse charge procedure applies. Without a plan, single files can be opened with credits bought at the Explorer rate shown on the pricing page. 4.2 Plans include a monthly credit allowance. Credits are valid for three months from the date they are granted and then lapse without compensation. Top-up credits can be bought at the price shown. 4.3 Opening a file uses the credits shown on the file before opening. A city file lists all projects of the city and is priced by their number. If the customer holds the city file of a city, project files in that city cost half. A file that is still being researched costs the same as a complete one; opening it starts the research, and the missing facts follow as updates within the twelve months of 4.4. 4.4 Within a plan, an opened file stays live for twelve months: updates and new signals are included. Outside a plan, a file is a snapshot without updates. 4.5 Credits are not refundable and cannot be exchanged for cash. 4.6 Research on contacts or other custom research is offered on request. It is quoted individually and only becomes binding when the customer accepts the quote.

5. Permitted use

5.1 The customer may use the files within its own organisation for its own sales and project work, including in its CRM. 5.2 It is not permitted to resell, publish or pass on files or substantial parts of them to third parties, to build a competing database from them, or to read the Service automatically beyond the export and API functions of the plan. 5.3 We may include individual marker entries in the data to detect unauthorised disclosure. 5.4 Where the customer uses files for outreach to contacts, the customer is solely responsible for compliance with applicable law on direct marketing and data protection.

6. Payment

6.1 Payment is processed by Stripe; we do not store card data. 6.2 Plan fees are invoiced in advance, monthly or yearly according to the billing interval chosen. One-off purchases are due immediately. 6.3 If a payment fails, we may suspend the opening of new files after a reminder with a reasonable grace period.

7. Term and termination

7.1 Plans with monthly billing have no minimum term and renew month to month. 7.2 The customer can cancel in the billing portal or by email at any time with effect from the end of the current month. 7.3 With yearly billing the plan runs for twelve months and renews for twelve months at a time, unless cancelled with effect from the end of the term. 7.4 For Enterprise, the scope of the set-up is set out in the offer; term and cancellation follow 7.1 to 7.3. 7.5 The right to terminate for cause remains unaffected. 7.6 After the end of the plan, opened files remain available as snapshots; unused credits lapse.

8. Data protection

8.1 We process personal data of seat holders according to our privacy policy. 8.2 Where we process personal data on behalf of the customer, the data processing agreement (DPA) applies.

9. Liability

9.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under product liability law and where we gave a guarantee. 9.2 For slight negligence we are liable only for breach of essential contractual obligations and limited to the typical, foreseeable damage. 9.3 Liability per calendar year is limited to the fees paid by the customer in the twelve months before the event, unless 9.1 applies. 9.4 We are not liable for business decisions the customer takes on the basis of files, in particular for lost tenders or orders.

10. Changes

We may change these terms for the future where this is required for legal, technical or product reasons. We announce changes in text form at least 30 days in advance. If the customer does not object within this period, the changes apply; we point this out in the notice.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Venue is Karlsruhe, Germany, where the customer is a merchant. Should a provision be invalid, the remaining provisions remain unaffected.
